The effect of this is to highlight that The Nightingale is a very regular poem, where Syrinx is a very irregular poem. It is as if Amy Clampitt teases the reader by making the first two stanzas of equal length, then throws in another couple of lines at the end. This therefore highlights her desire to make the poem seem irregular. This difference in regularity can also be seen through the metre of the poems. The Nightingale is mainly iambic pentameter throughout, with hypermetrical stresses on each of the last words in each line. The effect of this is to make the poem flow better and lead on to the next line, whereas Syrinx is extremely irregular switching between iambic and trochaic regularly. This switch in metre throughout the poem acts as a technique to again frustrate the reader. The tone of each poem is greatly affected by the contrast in layout and metre. The Nightingale seems to flow much better, giving the effect that reading the poem, is like listening to a mournful song. Syrinx on the other hand is very difficult and frustrating to read. The Nightingale also seems a more personal poem as it is written in the first person, whereas in Syrinx Amy Clampitt seems to be addressing her listeners and just uses: ââ¬Ëweââ¬â¢ (line 10) once. Therefore this gives The Nightingale a more deep and meaningful tone, where Syrinx has a very controversial tone. This shortage places everyone connected with these facilities at risk, not only patients and their families, but the health care staff as well.à With insufficient nurses available to oversee and to provide adequate care, nurses are forced to work longer shifts or extra shifts during the course of each pay period.à In addition, some care facilities find themselves replacing full-time nursing staff with either part-time or temporary nursing staff, or supplementing the available nursing care provided with nursesââ¬â¢ aides trained to take on lower level nursing tasks. In addition to the lack of available nursing staff, many of those nurses already employed by New York State are nearing retirement age.à With so many of the currently employed nurses and nurse educators nearing the ends of their careers, it is becoming even more imperative to bring new nurses into the system before these men and women leave it.à However, New York State Bill AO 3001 is not the manner in which to bring new nurses into the nursing field. According to its summary, the purpose AO 3001 is to provide scholarship and grant funding to individuals who study to enter the nursing profession.à These funds would be provided based on certain criteria and preferences specified in the bill.à Two of these items are similar to that of other awards, in that they call for evidence of academic merit and for evidence of financial need.à However, among other things, preference is given to individuals who have already obtained experience working in a healthcare setting and the ââ¬Å"highest degree of preferenceâ⬠will be given ââ¬Å"to recipients applying for second or subsequent years of fundingâ⬠(Title VI, Section 2, subdivision 4-6). While some degree of selectivity must be given when allotting scholarships and grants to students, it is the provision that the Commissioner of Education will select between candidates should the number of candidates exceed the number of awards that causes some concern.à How will these awards be made and to what criteria?à Can we be certain that the criteria being used will be to the best interest of the nursing profession? In addition, the Commissioner can also decide where to assign the nurses who accept this funding.à According to Title VI, Section 2, subdivision 7, these nurses must work in a nursing capacity for 18 months or as nurse educators for three semesters at a minimum if they receive these funds, which is a reasonable requirement; however, the nurses must also agree to work in a facility that serves Medicaid beneficiaries or social services client, as well.à It is reasonable to expect nurses, or any scholarship recipient, to perform certain reasonable tasks to fulfill the requirements of a scholarship or grant.à Some teachers, for example, are forgiven their educational debts if they work in certain areas of the country. However, these teachers choose what areas of the country in which they will teach and with which population of students that they will fulfill the requirements of the agreement.à To limit new nurses to working for facilities in which they may not have access to the equipment and to the funds that will enable them to best use and improve upon the skills that they have attained in their education, particularly when this knowledge is fresh in their minds, will simply hurt their futures in the profession. Bringing new nurses into the profession is indeed a major problem facing New York State, as well as other areas of the country.à The true difficulty, however, lies with retention once these students have graduated.à Nurses face schedules that leave them sleep deprived and at risk for injuries.à Nurses are often asked to perform their jobs with substandard equipment or with insufficient funding. In many facilities, nurses still do not receive the respect that their positions as highly trained and educated members of the health care profession demand.à In addition to all of these things, nurses typically receive inadequate pay for the work that they do, even as they attempt to pay back expensive educational loans.à A far better solution to the nursing shortage would seem to be a two-pronged attack.à First, nurses should be paid at the value of their work to ensure that nurses do not leave the field in search of higher paid work.à Second, instead of restrictive scholarships and grants that send nurses to locations decided upon by the Commissioner, a solution similar to that provided for teachers should be offered.à Both solutions would leave the decision of who should be a nurse and where these nurses should practice in the hands of those best qualified to decide: nurses and other members of the health care profession. For the most part, it is agreed upon that protection of IP foster a competitive marketplace by encouraging disclosure of innovation. This disclosure, however, protects companies and individuals for a designated period of time, but allows others to build and improve upon prior innovation. This incentive mechanism forces creative individuals to share their genius with society which in turn endorses evolutions and new developments and without these benefits provided by IP protection, the marketplace would not operate as effectively. ââ¬Å"Without enforcement of these rights in the law, it would be difficult for society to prosper and grow. â⬠(Peterson 2012) There are four main types of intellectual property protected under U. S. law; patents, trademarks, trade-secrets and copyrights. The Apple vs. Samsung case, although extremely complicated and convoluted mainly covers patents. Patents are intended to stop others from making, using, selling or offering for sale a product that is described in the patent claim. It gives the patent owner the exclusive right. ââ¬Å"It is important to note that a patent does not give the patent owner the right to exploit the patented invention himself. The patent owner has only the exclusive right to stop others from doing so. â⬠(Peterson 2012) Much of what we in the U. S. have been hearing about is the case decided in California. However, this technology war is not exclusive to America. In fact, there are cases in at least ten countries worldwide. The reason for this being, that intellectual property protections are not uniform. When an individual or a company applies for a patent within the U. S. , the protection only extends to the borders. Once a company stretches past the borders of The States, and goes global, it must apply for intellectual protection in each country it is attempting to sell within. ââ¬Å"There is often no consensus ithin countries on the appropriate approach and when the economic interests of different nations may dictate a different balancing of interests in the IPR law. â⬠(Wallerstein, Schoen Mogee, 1993) Although there are calls to make intellectual property rights uniform, each country has their own interests to protect, and has their own ideas about the extent of protecting intellectual properties. The U. S. is o ne of the strictest supporters of intellectual property rights, and for that reason, a jury of nine has ruled in favor of Apple to the tune of $1. 05 billion. Samsung has appealed, however, so the battle is far from over. Apple, the second largest seller of smartphones is in ongoing litigation with Samsung, the largest seller of smartphones about seven distinct patents. These patents covered everything from the ââ¬Å"pinch and zoomâ⬠to ââ¬Å"bouncebackâ⬠effect seen when scrolling. ââ¬Å"There are two types of patents at stake: utility patents, which control the features a phone or tablet can have, and design patents, which cover how they look. â⬠(Bosker Grandoni , 2012) According to The Verge, Appleââ¬â¢s final arguments went as follows,Steve Jobs shocked the world with the iPhone, changing the trajectory of the mobile industry. He framed Samsung, however, as a company with a stagnant line-up of products that faced faltering sales after the introduction of Apples device. Samsungs solution? A three-month dash to design what would become the original Galaxy S. In those three months Samsung was able to copy and emulate the worlds most successful product, he said. They have spent a billion dollars mimicking our designs and holding it out to the world so the Apple design is no longer seen as unique. It took Apple five years to create this revolution, and Samsung took three months to copy it. Thats truth, and thats simple, clear, and undisputed. (Bishop 2012) Samsung argued that Apple was trying keep all competitors out of the game unfairly. One of Appleââ¬â¢s major claims was that the products were so alike, that customers were mistakenly purchasing Samsungââ¬â¢s smart phones thinking that they were iPhones. But Samsungââ¬â¢s closing attorney claimed that this customer confusion was folly. The fact is consumers make choices, not mistakes theres no deception, theres no confusion, and Apple has no credible evidence of it. Apple, he said, thinks its entitled to ave a monopoly on a rounded rectangle with a touchscreen. (Bishop 2012) Samsung has claimed that their technology is altogether different and has in turn sued Apple for patent infringements. The American jury in the end, found Samsung guilty of willfully violating three of the utility patents, and six of the seven on trial. What Apple could not convince the jury of was that Samsung had violated a patent o n the physical design of the iPad. However, it was able to skillfully and successfully defend its claim to the rectangular rounded edges and rounded backs that was the original look of the iPhone previous to the iPhone 4. The case was less about the money, and more about setting an example. Appleââ¬â¢s message to world was that itââ¬â¢s innovations couldnââ¬â¢t just be copied without consequences and that a fair marketplace was one where competitors competed with new inventive products not reconstructed ones. The implications of this case are intricate, and knotty but that doesnââ¬â¢t stop the speculation from going rampant. Wall street reacted to the news by increasing the price of Appleââ¬â¢s shares and decreasing the prices of Google and Samsungââ¬â¢s shares.
